MEMBERSHIP AGREEMENT & TERMS AND CONDITIONS

1. MEMBERSHIP ELIGIBILITY

Membership is limited to individuals 18 years of age or older. Minors are not permitted to use the facility or participate in training at this time.

 

2. FACILITY ACCESS, DIGITAL ENTRY & OPERATING HOURS

First Strength is a coach-led training facility and does not operate as an open gym.Facility access is permitted only during posted operating hours and scheduled sessions.Members must maintain access to the First Strength Mobile App (Powered by Glofox) and the Kisi Mobile App for facility entry.Access credentials are proprietary and issued for individual use only.Unauthorized access, including but not limited to tailgating, sharing credentials, granting entry to non-members, or propping doors open, is strictly prohibited and may result in immediate suspension or termination of membership without refund.Operating hours may vary and may be modified with reasonable notice.

 

3. MEMBERSHIP TYPES & SCOPE OF SERVICES

Membership provides access to First Strength’s fitness facility and participation in small-group, coach-led personal training sessions, subject to availability, scheduling, and capacity limits.All coaching services are instructional in nature and do not constitute medical advice, physical therapy, rehabilitation, or treatment of any kind.

 

4. BILLING, PAYMENT AUTHORIZATION & CREDIT CYCLE

Membership fees are billed on a recurring 4-week (28-day) cycle and automatically renew until properly cancelled.By enrolling, you authorize First Strength, LLC to initiate recurring ACH withdrawals and/or credit/debit card charges using the payment method you provide.Charges occur every 28 days.You are responsible for maintaining valid and current payment information.Failed or declined payments may result in temporary suspension of access until payment is resolved.Credits & UsageSession credits must be used within the applicable 4-week billing cycle.Credits do not roll over and expire at the end of each cycle.All sales are final, except as required by California law.

 

5. RATE CHANGES

First Strength reserves the right to modify membership rates with advance written notice. Continued use of the facility after the effective date of a rate change constitutes acceptance of the new rate.

 

6. CLASS CANCELLATION & NO-SHOW POLICY

Due to limited class capacity (maximum 6 participants per session), the following policy is strictly enforced:A 12-hour cancellation window applies to all scheduled sessions.Sessions cancelled less than 12 hours before start time, or missed without notice (no-shows), will result in forfeiture of the session credit.No exceptions are made for late cancellations or no-shows.

 

7. MEMBERSHIP CANCELLATION & TERMINATION

Member-Initiated CancellationMembership can be cancelled for any reason and requires 15 days’ written notice, submitted via email to info@trainfirststrength.com.If your billing date occurs within your 15-day notice period, that payment will still be processed as usual. Membership credits will remain active through the end of the current billing cycle.No refunds are provided for unused credits or partial billing periods, except as required by law.Facility-Initiated TerminationFirst Strength reserves the right to suspend or terminate membership for:Unsafe or disruptive behaviorViolation of facility policies or posted rulesMisuse of equipment or digital access systems

 

8. ONE-TIME PURCHASES & SPECIAL PROGRAMS

Trial sessions, workshops, special courses, and other one-time offerings:Are non-recurring and do not establish ongoing membershipAre non-refundable, unless otherwise statedMay expireAre subject to availability and scheduling limitations

 

9. BOOK A FRIEND / GUEST POLICY

Members may use the “Book a Friend” feature to invite a guest to attend a scheduled class, subject to the following conditions:Each guest booking requires one class credit for the member and one class credit for the guest.Guests must be 18 years or older.All guests are required to complete and sign First Strength’s Liability Waiver and any other required forms prior to participating in a class. Guests who have not completed the required waiver will not be permitted to participate.A member may not bring the same guest more than once within a single four (4) week billing cycle, regardless of which member books the guest.Guests may not be current members or individuals with an active or recently expired membership.The Book a Friend feature is intended for occasional guest visits and referrals, and may not be used as a substitute for a membership.First Strength reserves the right, in its sole discretion, to limit, suspend, or revoke guest privileges if the Book a Friend feature is used in a manner that circumvents membership requirements or violates these Terms & Conditions.

 

10. MEMBER CONDUCT

Members must comply with all posted rules, safety guidelines, and coach instructions. Failure to do so may result in suspension or termination of membership at the discretion of First Strength.

 

11. ASSUMPTION OF RISK

Participation in fitness and training activities involves inherent risks. By participating, members voluntarily assume all risks associated with physical activity. A separate Liability Waiver & Assumption of Risk Agreement governs these risks in detail.

 

12. CALIFORNIA STATUTORY RIGHTS (MANDATORY NOTICE)

Five-Day Cooling-Off PeriodYou, the buyer, may choose to cancel this agreement without penalty or obligation at any time prior to midnight of the fifth business day after the date of this agreement.Death or DisabilityIf, by reason of death or disability, a member is unable to receive all contracted services, the member and their estate shall be relieved from the obligation of making payment for services other than those received prior to death or the onset of disability.RelocationIf a member moves more than 25 miles from First Strength, LLC and the contract cannot be transferred to a comparable facility, the member shall be relieved from future payment obligations upon written notice and reasonable proof of relocation.

 

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of California. By enrolling in membership and using the facility, you acknowledge that you have read, understood, and agree to be bound by these Membership Agreement & Terms and Conditions.
